설명
고용허가제도를 실시하는 방법은 「외국인노동자의 고용 및 관리에 관한 법률」을 법제화하는 데서 찾아야 한다. 또한 경과 규정을 두어, 현행 산업연수생 사용업체에 대상으로하여는 기존 연수계약기간 만료 시까지 산업연수생의 고용을 인정하여야 할 것이다. 따라서 「외국인노동자의 고용 및 관리에 관한 법률」에는 외국인노동자의 고용과 관리에 관한 내용과 절차를 규정하고, 노동자로서의 권리를 보장하고 그들의 인권 침해를 예방하기 위한 제도적 장치 등이 포함되어야 한다. 미등록 외국인노동자와 외국인 산업연수생에 대한 discrimination대우가 만연한 현실을 개혁하기 위해서는 현행 제도의 보완으로는 불충분하므로 별도의 입법이 필수적이다.
